DADA 1st Year : Introduction to DADA - L1# - Opinion Piece
Chapter 1
First, I would like to address about the difference between Light Spell and Dark Spell.
Spells is the matter of intent and purpose. Any Light Spells can be as dangerous as Dark Spell. It just the matter how gory and horrendous looking Dark Spell is that the were name as such. You can kill someone by casting Wingardium Leviosa by throwing a very big rocks or sharp objects to someone. You can kill someone by casting Diffindo on someone's neck or abdomen.
In the term of legalizing Dark Arts and integrate it to be used by magical society is the matter of proper regulation. Many Dark Spells are not as dangerous as Light Spell. Unforgivable Curse even could be used by Healers at St. Mungo's. While the patient is not coorperating, Imperius is the solution. Crucio was equivalent to muggle Electrical Cardioversion/ Deflibrurator (AED), used as a procedure to reset the heart’s rhythm back to its regular pulse. The last one is Avada Kedavra, killing curse that also the same as a procedure when muggle doctor (healer) stop the machine so any patient that was a lost cause (e.g. brain dead or other severe illness).
By those evidence alone, we can assume that it was better to regulate the use of Dark Spells. We can administer Verita Serum to convicts to see whether they cast the Dark Spells or any spells that used to intent harm upon others. Their punishment will be measured by how big their intent is, their motives, their victim(s), and the whole impact from the damage inflict upon by them. Many convicts that were thrown to Azkaban were innocent because they were in wrong place and time and just happen to be there. And the convicts also have to be checked properly. They can deflect that they cast it or confess by Verita Serum but without the wand, there wil not be enough evidence to punish them as the law give them. Without the wand present, the evidence will not as just as we hope it will be.
All in all, it was the matter of intent. If the Ministry can administer Verita Serum and give more throughout check to the supposed convicts, it will be possible to inflict to others how dangerous spells are, whether it was Dark or not. Spells is like a knife. We can use it to slice potion ingredients to help others or to stab someone to death. Spells are weapon, and I hope everyone can understand that.
